1. Agreement. The following terms and conditions (“Terms and Conditions”) apply to all visitors to or users of this Web site. By accessing this Web site, the visitor or user accepts and agrees to these Terms and Conditions. If a visitor or user violates any of these Terms and Conditions, Rent Great Space, LLC, a Washington limited liability company, d/b/a Rentgreatspace.com (“Rentgreatspace.com”), reserves the right to seek all remedies available by law and in equity for each violation. Should you object to any term or condition, any guidelines, or any subsequent modifications thereto or become dissatisfied with Rentgreatspace.com in any way, your only recourse is to immediately discontinue use of Rentgreatspace.com. Our services are available only to, and may only be used by individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to children (persons under the age of 18). If you are under the age of 18, you can use this service only in conjunction with, and under the supervision of your parents or guardians. If you do not qualify, please do not use our web site.

2. Fees . Rentgreatspace.com charges fees to users who place advertisements on the Rentgreatspace.com web site seeking to lease their residential, commercial, boat moorage, and storage space. Fees are based upon the number of advertisements placed during a given period. The fee schedule is as follows:

* For all monthly plans, If you do not display any ads during a single billing cycle, your account is considered idle. Idle accounts pay only a nominal fee of $1 per month, rather than their regular monthy fee. For more information, click here

The fees quoted above are exclusive of applicable taxes. Taxes, if any, charged by any governmental entity, are in addition to the quoted fees and are the responsibility of the user placing the advertisement. The fee for the first month of service is waived for all users placing advertisements on the Rentgreatspace.com web site seeking to lease their residential, commercial, boat moorage, and storage space, but only for the first time they place an advertisement with Rentgreatspace.com. Users who are visiting the Rentgreatspace.com web site to look at advertisements may do so for free. Users who are seeking to rent space from others, who do not find what they want from current listings, may register with Rentgreatspace.com and place a “Wanted Space” advertisement, without charge. Such “Wanted Space” advertisements will only be visible to users who have paid to place advertisements.

3. Payment. Payment must be made in U.S. Dollars paid by major credit card. Payment must be made in full at the time a user chooses an advertisement plan with Rentgreatspace.com, according to the fee schedule set forth above, subject to the waiver of the first month of service described above.

4. Copyright. All materials provided on this Web site, including but not limited to all text, logos, designs, graphics, images, sounds, information, software, documents, products and services (collectively, the “Materials”), and the selection, arrangement and display thereof, are the copyrighted works of Rentgreatspace.com and/or its vendors or suppliers. All Materials herein and all Rentgreatspace.com software are proprietary to Rentgreatspace.com and protected by worldwide copyright and other intellectual property laws. Except as stated herein, none of the Materials may be modified, copied, reproduced, distributed, republished, downloaded, displayed, sold, compiled, posted or transmitted in any form or by any means, including but not limited to, electronic, mechanical, photocopying, recording or other means, without the prior express written permission of Rentgreatspace.com.

5. License. Rentgreatspace.com hereby authorizes you to view, copy, download and print the Materials available on this Web site, provided that: (1) if you are a potential or actual renter, the Materials are used solely for personal, non-commercial purposes and if you are a property owner/manager, the Materials are used only for the purposes of using the services expressly offered by Rentgreatspace.com; (2) the Materials are not modified or redistributed; and (3) all copyright, trademark, service mark and other proprietary notices are reproduced as they appear in any such Materials. Except as expressly provided above, nothing contained herein shall be construed as conferring, by implication, estoppel or otherwise, any license or right under any patent, trademark or copyright of Rentgreatspace.com.

6. Trademarks. The trademarks, trade names and service marks (the “Marks”) displayed on this Web site are the property of Rentgreatspace.com or other third parties. Users are not permitted to copy or otherwise use these Marks without the prior written consent of Rentgreatspace.com or such third party that may own the Mark. The following list of Marks owned by Rentgreatspace.com is not exhaustive, and Rentgreatspace.com may own other Marks not included here: Rentgreatspace.com.

7. Privacy and Disclosure of Information. If there is a dispute between participants on this site, or between users and any third party, you understand and agree that Rentgreatspace.com is under no obligation to become involved. 9. Layout and Copy. Rentgreatspace.com reserves the right to determine the final design, layout and functionality of our web site, which is subject to change from time to time without notice. Rentgreatspace.com reserves the right to edit copy or amend the layouts or photographs supplied by any user, in order to create a more uniform and pleasant advertising environment for our visitors. Rentgreatspace.com reserves the right, at its discretion, to amend and edit copy entered into the Rentgreatspace.com online database. All copy edits submitted by any user are subject to review and approval of Rentgreatspace.com in its sole opinion. Notwithstanding its right to edit and amend copy and photographs, Rentgreatspace.com accepts and holds no liability for any loss or damage resulting from the design or positioning of the properties or changes made to the photographs and copy submitted by any user or edited by Rentgreatspace.com staff.

10. Photographs. By submitting a photograph either electronically through our website or by mailing a paper based photograph to our offices, the user who submits such photograph is representing an warranting that (a) he/she holds all intellectual property rights with respect to each submitted photograph, (b) he/she has secured from the copyright holder all rights necessary for the photograph to be used in an online advertisement, (c) that any people in the photograph have given permission for their likeness to be displayed in an online advertisement, (d) that the photograph accurately and fairly represents the subject of the photograph and has not been altered in any manner that would mislead a viewer of that photograph and (e) that he/she will indemnify and hold harmless Rentgreatspace.com from any cause of action arising from any misrepresentation with respect to any and all the photographs so submitted.

11. No Warranty of Continuous Availability. Rentgreatspace.com does not warrant that the operation of the Rentgreatspace.com web site will be uninterrupted or error-free.

12. Information Control. We do not control the content provided by users that is made available through our system. You may find advertisers' listings to be offensive, harmful, inaccurate, or deceptive. Please use caution and common sense when using the site. Please note that there are also risks of dealing with underage persons or people acting under false pretense. Additionally, there may also be risks dealing with international trade and foreign nationals. By using this site, you agree to accept such risks and Rentgreatspace.com is not responsible for the acts or omissions of users on the site. If you suspect any offensive or harmful activity, you may report a bad listing at any time to us.

13. Relationship. You and Rentgreatspace.com are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

14. Federal Fair Housing Act. All real estate and rental ads must comply with the Federal Fair Housing Act. The Fair Housing Act makes it illegal to advertise any preference, limitation, or otherwise encourage discrimination because of race, color, religion, sex, national origin, handicap, or familial status. You must comply with the Fair Housing Act and all rules and regulations pertaining thereto. Any failure to do so is grounds for immediate removal of your advertisement, without prior notice. You will defend, indemnify, and hold Rentgreatspace.com harmless for any violation of the Fair Housing Act and all rules and regulations pertaining thereto that you may commit.

15. Devices. You agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy our Web pages or the content contained herein without our prior expressed written permission. You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Rentgreatspace.com site or any listing, offer or transaction being conducted on our site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure.

16. Legal Compliance. As a condition of your use of this Web site, you warrant to Rentgreatspace.com that you will comply with all applicable laws, statutes, ordinances and regulations regarding your use of our service and any related activities. d. Rentgreatspace.com is not responsible for the content of, nor does it endorse, the third-party websites to which you may link using this website;

e. Rentgreatspace.com does not guarantee the accuracy of any information available on this website, and is not responsible for any errors, omissions, or misrepresentations, whether made by renters or otherwise and all information obtained on this website or from renters must be verified independently;

f. Rentgreatspace.com may make changes to its products and/or services and this website at any time and without notifying you or receiving your consent; and

g. while Rentgreatspace.com complies with state and federal civil rights laws, Rentgreatspace.com does not monitor transmissions of information by renters and lessors and thus assumes no liability for renters' and/or lessors' failures to comply with such laws.

24. Choice of Law, Jurisdiction, Venue, and Attorneys Fees. All rights, duties, obligations, and relations arising out of or related in any way to this agreement are governed by the laws of the State of Washington, without regard to its conflicts of laws principles. You hereby consent to the exclusive jurisdiction and venue of the Superior Court of King County, Seattle, Washington , for all disputes arising out of or relating to this agreement or the use of the Rentgreatspace.com web site or all services related thereto. Use of the Web site Rentgreatspace.com web site and all services related thereto is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. In the event of a dispute arising out of or relating to this agreement or the use of the Rentgreatspace.com web site or all services related thereto, the prevailing party shall be entitled to recover all fees, costs, and expenses of any kind or nature whatsoever incurred in resolving said dispute (including but not limited to attorney fees and expert witness fees).

25. Limitations. You agree that regardless of any statute or law to the contrary, any claim or cause of action against Rentgreatspace.com, or arising out of or related to use of the Rentgreatspace.com web site and all services related thereto, or the Terms and Conditions, must be filed within one (1) year after such claim or cause of action arose or be forever barred.

26. Severability. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
